Terms of Service

1. What PrivateDrive Is
PrivateDrive is a peer-to-peer marketplace platform that connects drivers who need parking with property owners who have available parking spaces. PrivateDrive is a technology platform and facilitator only — we are not a parking operator, parking lot owner, or transportation company.
PrivateDrive does not own, control, offer, manage, or provide any parking spaces. The spaces listed on our platform are owned and managed by independent hosts. PrivateDrive's role is limited to facilitating the connection between hosts and drivers and processing payments on their behalf.
By using PrivateDrive — whether as a host, a driver, or a visitor — you agree to these Terms of Service. If you do not agree, please do not use the platform.
2. Host Responsibilities
As a host listing a parking space on PrivateDrive, you represent and warrant that:
- You have the legal right to rent the space for compensation, including that your HOA rules, lease agreement, and local ordinances permit you to do so.
- Your listing accurately describes the space — its location, size, capacity, amenities, and any access requirements.
- The space is safe, accessible, and free from hazards that could damage a vehicle or injure a driver.
- You will provide clear, timely check-in instructions to confirmed drivers.
- You will honor confirmed bookings unless extenuating circumstances arise, in which case you must notify PrivateDrive support promptly.
- You are an independent contractor, not an employee or agent of PrivateDrive.
PrivateDrive reserves the right to remove any listing that violates these requirements or our community standards, without prior notice.
3. Driver Responsibilities
As a driver booking a parking space on PrivateDrive, you agree that:
- You will follow the host's house rules and any instructions provided at check-in.
- You will arrive on time for your booking and not exceed the booked time window without contacting the host.
- You will leave the space in the same condition as you found it.
- You will not park more vehicles than the space's listed capacity.
- You will use the space only for lawful purposes.
- You are responsible for any damage caused to the host's property by you or your vehicle.
4. Payment Terms
PrivateDrive charges a 20% platform fee on all bookings. Hosts receive 80% of the booking amount. Payouts are processed via Stripe Connect and typically sent the same night as the booking, after the driver has arrived and the booking is confirmed complete.
Drivers are charged the full booking amount at time of booking. The booking amount includes the host's listed price plus PrivateDrive's service fee. No additional fees are charged at the space.
All payments are processed securely through Stripe. PrivateDrive does not store card information. By completing a booking, you authorise PrivateDrive to charge the payment method on file.
5. Liability Disclaimer
PrivateDrive is not liable for any loss, damage, injury, or claim arising from the use of any parking space listed on our platform. This includes but is not limited to:
- Property damage to vehicles or the host's property
- Personal injury to drivers, hosts, or third parties
- HOA violations, lease violations, or municipal code violations arising from a host's listing
- Theft, vandalism, or other criminal acts occurring on a listed space
- Disputes between hosts and drivers
PrivateDrive provides the platform infrastructure only. All disputes between hosts and drivers must be resolved between the parties, with PrivateDrive support available to mediate in good faith. PrivateDrive's liability in any dispute is limited to the amount of the platform fee collected from the transaction in question.
6. Cancellation Policy
- Full refund: Cancellations made 24 or more hours before the booking start time receive a 100% refund.
- 50% refund: Cancellations made within 24 hours of the booking start time receive a 50% refund.
- No refund: No-shows and cancellations after the booking has started are not eligible for a refund.
- Host cancellations: If a host cancels a confirmed booking, the driver receives a full refund and PrivateDrive may apply a cancellation penalty to the host account.
Refunds are processed to the original payment method and typically appear within 5–10 business days depending on your bank or card issuer.
7. Walk or It's Free Guarantee
PrivateDrive offers a "Walk or It's Free" guarantee on select listings marked with the guarantee badge. Under this guarantee, if a driver with a confirmed booking arrives and cannot park due to the host's failure to provide access or availability, the driver will receive a full refund.
To claim this guarantee, the driver must contact PrivateDrive support within 1 hour of the scheduled booking start time with photographic evidence that the space was unavailable or inaccessible. PrivateDrive will review the claim and issue a refund at its sole discretion if the claim is verified.
This guarantee does not apply to situations where the driver arrived at the wrong time, wrong address, or was denied access due to their own conduct.
8. Account Termination
PrivateDrive may suspend or permanently ban any account at any time, with or without notice, for violations of these Terms, community standards, or any applicable law. Banned hosts forfeit any pending payouts for bookings completed after the violation occurred.
Users may close their account at any time by contacting support. Pending payouts for completed bookings will still be processed to the connected Stripe account.
9. Governing Law
These Terms of Service are governed by the laws of the State of California, United States, without regard to its conflict-of-law provisions. Any legal disputes arising from these Terms or your use of PrivateDrive shall be subject to the exclusive jurisdiction of the courts in Los Angeles County, California.
